President Ruto wins as Appellate Court Lifts Finance Act

The Court of Appeal has set aside an order barring Finance Act, 2023 

In their ruling on Friday 28th July, Justice Mohammed Warsame, Kathurima M’Inoti and Hello Omondi said appeal filed by Cabinet Secretary Treasury has merit

They had set the date of ruling on Friday after Treasury Cabinet Secretary Prof Njuguna Ndung’u the suspension of the Act is affecting government operations

Ndung’u pleaded with the court saying these will be a budgetary crisis if the order is not lifted

Chief Justice Martha Koome has already appointed a three-judge bench that will hear and determine the case saying the implementation of the 2023 filed by Treasury Cabinet Secretary has sound judgement

The three judges are Justices Daniel Majanja Lawrence Mogambi and Christine Meoli

High Court had temporarily suspended implementation on 30th June, 2023
