The embattled husband of the late Rosemary Chemutai has voluntarily withdrawn an application seeking to stop her burial.
Lawyers representing the family of Rose , Danstan Omari, Swigga Matina and Stanely Kinyanjui told journalists at Milimani law court the husband of the deceased Kevin Mwige Kimwatu chose to withdraw an application without cohension, saying he would abide by the decision taken by family members and parents.
Lawyers representing parents of the deceased, Felix Kiptum and Philip Lagat said they will abide by the decision of the husband of the deceased to withdraw the application seeking to stop the burial of a beloved wife.

The lawyers said that the deceased body has already been interred in Kericho county without any interruption from the family or any other person.
The deceased was an employee of Kenya commercial bamk (KCB) and before her demise she had given firm instruction to the bank on how her four children will access money for their education and other social needs.
They said any dispute that would arise including inheritance will be solved under the customary law or through the succession cause.
