Information and Communication Technology, Cabinet Secretary, Eliud Owalo, is wanted to be jailed by Former KBC managing director, Naim Bilal over contempt of court orders.
According to Naim, CS Owalo failed to honour court orders and reinstates him back to the corporation.
This, is after the Employment and Labour Relations Court, ruled that Bilal’s retrenchment was illegal, unconstitutional and indecorous.
The court ordered the public service commission, to renew the contract Bilal had with KBC.
The labour court further issued a restraining order against ICT ministry, head of public service or the Attorney General from hiring any other person into Bilal’s position (managing director position at KBC).
The court stated, “The respondents are hereby restrained by way of a permanent injunction from recruiting any other person for the position of managing director, KBC.
However, Eluid Owalo did not do as ordered. Bilal has filed a petition wanting Owalo to be jailed.
Bilal stated,”Eliud Owalo, Cabinet Secretary or his successor to committed to civil jail for disobedience of court orders issued on October 31.”
“On November 8, the ICT CS and the head of Public Service Commission (PSC) were served with the decree. ICT CS has refused and or declined to obey court orders,” Bilal added.
CS Eliud Owalo in his end, has however, refuted claims that he failed to adhere to court orders. He further stated that the government has appealed in order to challenge the court’s decision.
Owalo said, “Government has, however, filed an appeal before the Court of Appeal to challenge the judgment issued in favor of Bilal. The matter is, accordingly, alive before the court
