High Court dismisses conservatory orders sought by Gachagua’s defence lawyers

Gachagua’s lawyers have now threatened to move to appellate court to seek an injunction

Blow to Impeached Deputy President Rigathi Gachagua as High Court paves way for the swearing in of nominated and approved Interior Cabinet Secretary Prof Kithure Kindiki as Substantive Deputy President

This comes after the 3 Judge bench cancelled all temporary orders stopping Senate’s decision to remove Gachagua from office since he was impeached by the both bicameral parliament.

This means Prof Kindiki will be sworn in anytime from tomorrow

However, Gachagua’s defence team are still putting spirited fight to High Court to make an injunction of the impending swearing in of Prof Kithure Kindiki

Advocate Ndegwa Njiru threatens to move to appellate court to stop all the lifted conservatory orders that gives birth to the swearing in of Gachagua’s successor

They argued that Independent Electoral and Boundaries Commission IEBC must be in place to ascertain whether Kithure is a registered voter or not, and if he belongs to any political party

The Executive’s Defence Team led by Attorney General through Prof Githu Muigai and Prof Tom Ojienda as well as Dr Thiankaru argued that the High Court had made the ruling and that Appellate Court can’t reverse owing to the fact that this morning noted the case to be mentioned on 6th November, 2024

The Court of Appeal told the Gachagua led defence lawyers to serve all interested parties before submitting objections to seek more conservatory orders extending the swearing in of Prof Kithure Kindiki
