Elgeyo Marakwet Senator Kipchumba Murkomen has termed barring of Mombasa gubernatorial candidate on Wiper ticket Mike Mbuvi Sonko as an illegality that shouldn’t be allowed to succeed
Speaking at Senate Chambers on Tuesday 21st June, Murkomen who is of United Democratic Coalition led by Deputy President William Ruto, said that the law needs to be amended to allow impeached politicians vie for elective seats
“Mr Speaker, how comes if someone was convicted of a murder case and served sentence for about five or ten years can still vie for an elective seat.
Yet, here we have governors who were impeached by 24 senators who had been bribed by the deep state, we are talking of governor who was elected by million voters in Nairobi-Sonko.
Don’t we see it as unfair and abuse of systems of jurisdiction to barr someone who was voted by the majority and stands to be elected by the majority because of the decision made by the corrupted individuals,” Murkomen asked
The vocal legislator who once been a senate majority leader under Jubilee Party now calls for jurists to dissect and deliberate the law with a view of amending it.
He said that the system is being applied to punish people who were condemned by mob justice which is against the tenets of human rights
“Remember there is one of the Deputy Governor who was nearly to be removed from office just because of chewing gum at the chambers.
The standards and reasons for impeaching are to low and should be used to kill someone’s political career because the time of impeachment depends with the moods of the house and how some people have been compromised by the opponents,” He added
On a quick rejoinder, Senate Minority Leader who is Siaya Senator James Orengo informed the house that peculiarity was derived from the constitution of Kenya and therefore should be looked at it entirely
“I want to inform senators that Murkomen is raising very fundamental question but general impeachments are political processes even in the United States of America, in relation to Donald Trump, it really matters what he’d done despite having the right numbers
So, the answer lies with the constitution, if you read the eligibility and all with the bill of rights and principles of double jeopardy, I think the answer is in our constitution,” Senior Counsel James Orengo informed the house
Sonko has been having hard times in his political career after he was barred again third time on yesterday by the IEBC’S dispute resolution committee to run for the Mombasa governoship position on a Wiper ticket
He has since vowed to move to the apex court to challenge what he terms illegal procedures and application of unfair judgement in barring him to context any political seat in Kenya, considering others who have serious pending cases in court and have already been cleared by the electoral body
