Kitui County Members of Assembly have unanimously watered down the formerGovernorCharityNgilu’s sponsored motion through her allied MCA Alex Nganga over vetting of nominated County ExecutiveCommittee Members
In a ruling made by, the County Assembly Speaker, Hon. Kevin Kinengo Katisya on Wednesday 7th December, during the afternoon plenary sitting gave a wide reasonable grounds on why they should continue vetting the nominees
Katisya, in his considered ruling on whether the County Assembly would be acting in breach of Section 42(2) of the County Governments Act 2012 in vetting and considering Governor’s nominees to the Kitui County Executive Committee outside the statutory timelines, said no breach of the laws
On 22nd November 2022 during the Assembly’s afternoon sitting, Hon. Alex Nganga Mutambu, Member for Miambani Ward/Minority Party Leader made a request for a statement pursuant to Standing Order No. 41(2) by seeking the Hon. Speaker’s considered ruling on the constitution of the Kitui County Executive Committee.
Hon. Nganga said that the Governor acted in blatant breach of the law by not submitting the nominees within the stipulated period.
‘’Hon. Members, I sought clarification from the H.E the Governor on what had occasioned the delay in submitting the nominees.
H.E the Governor acknowledged the delay in submitting the names and attributed the same to the rigorous process involved in identifying the persons suitable and qualified for appointment as members of the County Executive Committee.
Some of the reasons cited by H.E the Governor are compliance with gender rule in line with Article 197 of the Constitution and regional balance as provided for under Section 35 of the County Governments Act’’. The Speaker stated.
The motion which was sponsored by immediate former Governor Charity Kaluki Ngilu had elicited mixed reactions and raising political temperatures among the politicians including members of county assembly
Mr Katisya made it clear that the Governor did not breach Section 42(2) of the County Governments Act as the same become inoperative immediately upon the lapse of 21 days after the swearing-in of the members of the County Assembly upon which the Public Appointments (County Assemblies Approvals) Act become applicable.
The Speaker urged Hon. Members are to be guided by Article 185 as read with sections 8 and 9 of the County Governments Act in ensuring that they partner with the Executive for efficient service delivery to the great people of Kitui.
