The lobby group is seeking to compel Clerk of the National Assembly to act upon their petition
They sought the removal from office the Inspector General of Police Japhet Koome over police brutality
Clerk of the National Assembly in a letter statement signed by Dr Sarah Kioko dismissed the petition saying only President can remove IG
Operation Linda Ugatuzi have moved to High Court seeking to compel Clerk of the National Assembly to forward their petition to the Speaker of the National Assembly Moses Wetangula for tabling
Led by their Chairperson Prof Fred Ogola, the lobby group seeking removal from office the Inspector General of Police Japhet Koome, faulted clerk of casually dismissing their, 27th July, grounded petition
“It was so shocking when I heard clerk of the National Assembly has dismissed our petition very pedestrianily because the way we know it, Inspector is the commissioner in the National Police Service Commission and a member of the constitutional commission can only be removed from office through a petition to the National Assembly,” Ogola clarified
At the same time, OLU Secretary General Calystus Wafula, accused Mr Koome of using excessive force which violated human rights during the anti-government protests leading them to seek his immediate ouster
“The Clerk of the National Assembly has also violated the constitutional rights by dismissing public petition and therefore we are going to court to compel him to foward the petition to the Speaker for tabling and subsequent debate by the Members of the Parliament,” Wafula divulged
“The Clerk of the National Assembly took upon himself to dismiss our petition even before giving parliament time to ventilate. I find this inappropriate and I believe is acting on the instructions from the President who seems to control parliament just like he managed it to pass a bill which was draconian.
This has made, Parliament to remain being placed where justice is being taken away from Kenyans yet Kenyans do elect parliament,” Ogola added
On his part communication director Evans Momanyi claimed that there was a enough evidences to prove that a special police force had been formed to shoot and kill innocent protesters as they carry out their constitutional rights
“Tukona ushahidi wa kutosha ya kwamba kuko na special unit in that police force ambao walikuwa formed wakati wa maandamano na ndio tunaenda ICC kama OLU na jina lake lilikuwa hapo,” Momanyi claimed
They vowed to go to court to seek interpretation whether the ckerk of the national assembly can stop a course of petition and if not so to order him table the petition before parliament for action
“We have every reason to believe clerk is acting on directives from the President, we shall not allow the executive to capsize the legislation. Let the Members of Parliament be allowed to ventilate matters touching humanity without interference from the presidency,” They underlined
